Managing the Absent Employee While Navigating the Law

One of HR's intractable challenges is managing sick, injured, ill, disabled, or otherwise absent employees. The ADA and the FMLA made this process complicated enough in years past; but now, the proliferation of state and local paid-sick-leave laws, such as those recently passed in Chicago and Cook County, have added another layer of complexity and risk. In this presentation, Neil H. Dishman of Jackson Lewis P.C., an attorney who helps employers prevent and resolve disputes with employees, will provide the road map through this maze. Join us as Mr. Dishman covers both the legal and business sides of managing absent employees. Attendees will leave with many practical action items on subjects including:

  • The mess created by the wave of paid-sick-leave laws and the strategies for easiest compliance.
  • Whether "unlimited PTO" policies are a viable solution for businesses.
  • Practical tips for handling reasonalbe accommodations under the ADA.
  • FMLA pointers, with a particular focus on tactics for combatting FMLA abuse.
  • How the change from the Obama to Trump administrations has affected, and will affect, all of the above.


About our Presenter:

Neil H. Dishman is a Principal in the Chicago, IL office of Jackson Lewis P.C., a national law firm representing management exclusively in workplace lawa nd related litigation. His business is helping employers prevent and resolve disputes with their employees.

Mr. Dishman helps employers reduce risk and minimize legal costs by giving advice on difficult personnel decisions before litigation ensues. When litigation is unavoidable, he helps employers protect their assets and reputations by vigorously and efficiently defending them from employee lawsuits. Mr. Dishman counsels and defens employers on a wide spectrum of issues, including rac,e sex, age, religion, national origin, disability and sexual-orientation discrimination; sexual harassment, retaliatory discharge, Family and Medical Leave; and wage-hour compliance. He asists employers in a wide variety of industries, with particular experience in the property-management, non-profit, manufacturing and health-care fields. Mr. Dishman has jury-trial experience and is a member of the Trial Bar of the U.S. District Court for the Northern District of Illinois.

Mr. Dishman has garnered the accolades of his peers for his work in advising and defending employers. He was named to the 2013-2017 annual Best Lawyers in America lists, and he has been named to the annual list of "Rising Stars" by Super Lawyers magazine, a distinction accorded to no more than 2.5% of Illinois Lawyers, in every year from 2009 to the present.
